Privacy Policy

1. Who This Policy Applies To
This Privacy Policy applies to all users of Humanity AI, including students (Year 0–12) and their parents or guardians. We are committed to protecting the privacy of children in accordance with the Australian Privacy Act 1988 and the guidance of the Office of the Australian Information Commissioner (OAIC).
2. What Data We Collect
We collect the following personal information when you register and use our service:

We do not collect:
- Payment card details (handled securely by Stripe)
- Sensitive information such as health data, ethnicity, or religion
3. How We Use Your Data
We use your personal information to:
- Deliver personalised AI tutoring aligned to your year level and curriculum
- Track and display your learning progress
- Send account-related emails (verification, notifications, consent requests)
- Comply with our legal obligations under Australian law
We do not:
- Sell your data to third parties
- Use your data for advertising
- Use your tutoring sessions to train AI models without your explicit consent
4. Children's Privacy
For students in Year 0–8 (under 15), we require explicit parental or guardian consent before activating an account. Parents may:
- View their child's account activity upon request
- Request correction of any inaccurate data
- Request deletion of the account and all associated data at any time
We take extra care with children's data and apply the highest level of data protection to under-15 accounts.
5. AI-Generated Content
Tutoring responses are generated by AI. Session transcripts may be stored to support your learning progress tracking. These transcripts are not reviewed by humans except where required for safety, legal compliance, or to investigate a reported issue.
6. Data Storage and Security
Your data is stored on servers located in Australia. We use industry-standard encryption in transit (TLS) and at rest. Access to personal data is restricted to authorised personnel only.
7. Data Retention
We retain your personal data for as long as your account is active. Upon account closure, all personal data is deleted within 30 days, except where retention is required by law.
8. Third-Party Services
We use the following trusted third-party services:

Each provider operates under their own privacy policy and is bound by appropriate data processing agreements.
9. Cross-Border Disclosure of Personal Information
Some of the third-party services listed in Section 8 are based, or process data, outside Australia. In particular, tutoring content sent to our AI provider (OpenAI) and payment details sent to our payment processor (Stripe) may be processed on servers located in the United States and other countries where those providers or their subprocessors operate. Real-time audio/video session data handled by LiveKit may similarly be routed through infrastructure outside Australia depending on session location.
Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure that recipient handles your information consistently with the Australian Privacy Principles, including by relying on providers that maintain appropriate data protection commitments (such as data processing agreements, encryption in transit, and recognised security certifications). By using the Service, you consent to this overseas handling of your personal information for the purposes described in this Policy.
If it is not practicable for us to identify every specific country your data may be sent to (for example, because a provider uses global or dynamically-allocated infrastructure), we describe this in general terms as above rather than list every possible location.
10. No Guarantee of Absolute Security
While we take reasonable technical and organisational measures to protect your personal information (see Section 6), no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security, and to the extent permitted by law, we are not liable for unauthorised access to, or loss, misuse, or alteration of, your personal information that occurs despite these reasonable measures, except where caused by our negligence or a breach of the Australian Privacy Principles.
11. Data Breach Notification
If we become aware of a data breach involving your personal information that is likely to result in serious harm, we will comply with our obligations under the Notifiable Data Breaches (NDB) scheme in Part IIIC of the Privacy Act 1988 (Cth), including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.
12. De-identified and Aggregated Data
We may create de-identified or aggregated data from the personal information we collect (for example, aggregate progress statistics across year levels or subjects) for purposes including service improvement, research, and reporting. Once information has been de-identified such that it can no longer reasonably be used to re-identify an individual, it is no longer personal information and this Policy does not restrict our use of it.
13. Automated Decision-Making and AI Assessments
Progress tracking, quiz scoring, and tutoring feedback may be generated using automated, AI-based processes. These outputs are intended to support your learning and are not a substitute for a qualified teacher's professional judgement. If you have concerns about an automated assessment or AI-generated feedback, you may contact us at support@ilivehere.ai to request a human review.
14. Your Rights Under the Australian Privacy Act
You have the right to:
- Access the personal information we hold about you
- Correct inaccurate or outdated information
- Request deletion of your data (subject to legal retention requirements)
- Lodge a complaint with the OAIC at oaic.gov.au if you believe your privacy rights have been breached

15. Changes to This Policy
We will notify you by email at least 30 days before making material changes to this Privacy Policy. The version number and effective date at the top of this document will be updated with each change.
